Detailed Legal Framework
Please read these terms carefully before booking any service with GATIX™.
1. General Terms of Use & Copyright
Acceptance of Terms: By accessing the GATIX™ website or booking our logistics services, you agree to be bound by these terms. GATIX™ is a registered trademark and a legitimate entity operating under GSTIN: 06ERRPS3167LIZW and MSME: 22-0008280.
Intellectual Property: All content, logos, text, and operational software on this site are the exclusive property of GATIX™. Unauthorized reproduction, reverse engineering, or commercial redistribution will attract immediate legal action under the Indian Copyright Act, 1957.
Limitation of Liability: GATIX™ acts as a premium logistics provider. We are not liable for indirect, incidental, or consequential damages (including loss of business profits or data) arising from unforeseen transit delays caused by natural disasters, strikes, or route blocks (Force Majeure).
2. Transit Risk, Insurance & Claim Settlement
Risk Coverage Recommendation: Indian terrains can be unpredictable. We strictly mandate clients to opt for Carrier Risk Coverage (Transit Insurance) by paying the designated FOV (Freight on Value) charges. GATIX™ operates under Section 11 of the Carriage by Road Act, 2007.
Vehicle Transportation (Car & Bike): Claims will only be entertained for exterior, visible transit damage documented at the time of unloading. GATIX™ holds ZERO liability for any internal, mechanical, or electrical failures (e.g., Engine, Battery, AC) as our crew does not conduct mechanical audits prior to loading.
Damage Reporting Timeline: Any claim regarding physical damage MUST be reported via email to our support team within 72 hours for household goods, and within 12 hours for Car/Bike deliveries. Claims submitted after this window, or if the “Proof of Delivery (POD)” is signed as ‘Received in Good Condition’, will be legally void.
Restricted Items: We strictly prohibit the transport of perishables, jewelry, cash, hazardous chemicals, compressed gas cylinders, and narcotics. Loading such items voids all transit insurance immediately.
3. Cancellation, Pricing & Refund Policy
Pricing: All quotations are flat-rate based on declared inventory and distance. Any addition to the inventory at the time of packing will result in a revised quotation. GATIX™ reserves the right to amend pricing prior to the commencement of packing if the physical survey drastically differs from the virtual declaration.
Cancellation: Bookings can be canceled without penalty within 24 hours of confirmation, provided the packing crew has not been dispatched. Once the consignment is packed or in transit, no cancellation requests will be honored.
Refunds & Chargebacks: Approved refunds will be processed to the original payment source within 7-10 business days. By utilizing our authorized payment gateways, clients waive the right to initiate unauthorized bank chargebacks without first engaging in the GATIX™ dispute resolution process.
4. Privacy Policy (DPDP Act 2023 Compliance)
Data Collection: GATIX™ collects necessary PII (Personally Identifiable Information) including names, addresses, phone numbers, and location data solely for the execution of logistics services and legal invoicing.
Data Usage & Protection: In compliance with the Digital Personal Data Protection (DPDP) Act of India, 2023, your data is encrypted and strictly used for operational routing, customer support, and legal compliance. We do not sell your personal data to third-party marketers.
User Rights: You retain the right to request access to, correction of, or deletion of your personal data from our active databases, subject to Indian tax and logistics retention laws. Privacy-related queries can be directed to our Grievance Officer via the Contact Us page.
5. Anti-Bribery & Anti-Trust Charter
Zero Tolerance for Corruption: GATIX™ enforces a strict Anti-Bribery policy. Employees, vendors, and clients are prohibited from offering, promising, or accepting kickbacks, unauthorized cash tips, or inappropriate gifts to influence service levels.
Fair Competition: We operate strictly within the boundaries of the Competition Act, 2002. GATIX™ does not engage in cartel formations, price-fixing with competitors, or dividing operational territories illegally.
6. Governing Law & Jurisdiction
These terms and all operational contracts are governed exclusively by the laws of the Republic of India. Any legal dispute, claim, or litigation arising out of or relating to GATIX™ services shall be subject to the exclusive jurisdiction of the competent courts located in Gurgaon, Haryana, India.
